Terms & Conditions

Definitions - 1. “We” means Roller Doors Ltd (T/A Metal Gates Direct) 2. 'Customer' means customer of the Company 3. 'Conditions' means these conditions of sale. 4. 'Contract' means any contract entered into for the sale of goods by the Company to the customer. 5. 'Goods' means any Goods that are the subject of any contract and shall include any part or parts of them and materials incorporated in them. 6. 'Carrier' the company used to deliver the Goods to the Customer.

Terms & Conditions of Sale

  1. Unless otherwise agreed in writing, all orders are subject to these Terms and Conditions and are subject to availability at the time or ordering.
  2. These conditions apply to all contracts to the exclusion of all other conditions, either express or implied by statute or otherwise to the extent as is permissible by law.
  3. Acceptance of the goods by the customer shall be deemed to be conclusive evidence before any Court of Arbitrator that these Conditions apply
  4. We reserve the right to amend the Conditions without prior notice.
  5. Customers are advised to check for any variations to the conditions prior to ordering.

Order Acceptance

  1. The customer is responsible for providing details that are accurate to their requirements.
  2. We accept no liability for any goods that are incorrectly ordered by the customer and will be unable to accept returns for made to measure items and bespoke products.
  3. We reserve the right to refuse any order.
  4. An order is not deemed to of been accepted by the Company until such time that the goods have been delivered to the customer. We reserve the right to cancel any order until that point (in these instances a full refund will be provided).
  5. We operate a zero-tolerance policy to threats and abusive behaviour towards our staff. In these instances, any order will be cancelled with immediate effect.
  6. Orders are placed on the basis that the customer has read and agreed to accept these conditions.

Orders

  1. All prices are subject to VAT at the rate applicable at the time of ordering.
  2. We reserve the right to change the price advertised before you place an order.
  3. No additional charge is applied for payments made via credit or debit card.
  4. We must receive payment in full at the time of placing the order.
  5. Quotations are not offers to treat and may be revised or amended at any time prior to acceptance of the order.

Cancellation of Order

  1. Where a customer wishes to cancel the order for a standard item, a full refund will be provided (the goods must not of been dispatched with the carrier).
  2. Orders cancelled by the customer after the point of dispatch with the carrier (or rejected at the point of delivery) will incur carriage charges and the customer will be responsible for returning the goods at their own expense.
  3. Orders for made to measure items, bespoke products and variations of products that are not shown online cannot be cancelled once manufacturing has commenced.
  4. Cancellation of any order must be made in writing.

Installation

  1. All products are sold on a supply only basis.
  2. We accept no liability for any installation or for any costs the customer may incur when employing a 3rd party installer.
  3. All goods must be correctly installed and used for their intended purpose.
  4. We accept no liability for any product that is incorrectly installed.

Returns & Refunds

  1. When acting as a “consumer” the customer may cancel any order for standard items shown on this website within 14 days of receipt of the goods (starting the day after delivery). This does not apply to business to business transactions as these orders cannot be cancelled once the goods have been delivered.
  2. Returns must be made within 14 days of the date which you informed us of your wish to cancel the oder.
  3. Under no circumstances will we accept returns or provide refunds for bespoke items, non-standard products and made to measure items.
  4. We will only accept returns for items that have not been installed, are in original condition and where possible in their original packaging.
  5. We do not make collections for unwanted items. The customer is responsible for returning any order and must bear the cost or returning the item.
  6. The customer is responsible for obtaining proof of delivery and receipt of any returned item.
  7. In the event you wish to return an item, you must first contact us to obtain the returns address.
  8. Refunds can take up to 28 days and are paid back to the original card used when placing the order.
  9. We are unable to refund the original delivery charge.

Liability

We will not accept liability for any claims, loss, damages, demands of any kind including direct, indirect, incidental or consequential loss or damage whether arising from loss of revenue, profits or otherwise.

Delivery and Title

  1. Goods will be delivered in accordance with your order and a valid signature may be required upon delivery.
  2. Delivery times are approximate, and we accept no liability if the advertised lead times are not met.
  3. If you have not received your goods within 28 working days of placing your order you must contact us and we will investigate the delay.
  4. All deliveries are made to ground floor only and on occasion may be split into multiple deliveries by the courier.
  5. Goods that are damaged on delivery must be signed for as “damaged” or where this is not possible must be reported to us within 5 working days of the date of the delivery.
  6. In the event of a claim for damaged goods it is essential the items have not been installed and photographic evidence will be required.
  7. Where specific instructions are given to leave the goods without a signature, we accept no liability for the safety and security of these items.
  8. Failed deliveries may be subject to additional carriage charges.
  9. Title of the goods shall pass to the customer once the delivery has been made
  10. We are not liable for any damage to your property caused by the couriers. 

Warranty Information

  1. All goods supplied are guaranteed for a period of 12 months from the date of delivery and covers manufacturing defects only. The guarantee does not cover against rust or corrosion. For timber products the guarantee does not cover twisting, warping or cracking of the timber nor does it guarantee against rot and decay.
  2. Nothing in these Conditions shall operate to add to vary or alter the terms and conditions of the manufactures warranty. To claim under the terms of any guarantee the customer must notify our sales team of the manufacturing fault and must include the original invoice or order number.
  3. Where necessary, we will arrange to inspect the goods and if deemed appropriate will either repair or replace the item.
  4. Replacements will be granted on a supply only basis and will be at the discretion of the manufacturer. 
  5. All products must be installed and maintained in the correct manner.
  6. The guarantee will become void if the product is not handled, stored, maintained, or installed in the correct manner.


Law
1. We shall not be shall not be liable to the customer, or deemed to be in breach of the any of the Conditions of the Contract whether set out in these Conditions or implied by Law or Statute by reason of any delay in performing due to events outside the control of the company.


Your statutory rights remain unaffected.

 

Dispute Resolution

If you wish to make a complaint about any aspect of your order please send an email to sales@metalgatesdirect.co.uk stating the nature of the problem. You must also include any relevant information and we will investigate the matter further.
